1. Introduction

Welcome to GoGrowth. These Terms of Service ("Terms") govern your access to and use of the GoGrowth platform, website, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

GoGrowth is operated by Rosbech Media Consult ApS (CVR: 39337975), a company registered in Denmark ("we", "us", or "our").

Please read these Terms carefully before using our Service. If you do not agree to these Terms, you may not access or use the Service.

2. Service Description

GoGrowth is a growth hacking platform that provides:

  • A curated database of growth hacking strategies and tactics
  • Filtering and search tools to find relevant growth strategies
  • AI-powered growth hack generation (where applicable)
  • Educational content and resources for entrepreneurs and marketers

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

3. User Eligibility

To use the Service, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable laws
  • If representing a company, have the authority to bind that entity to these Terms

By using the Service, you represent and warrant that you meet these requirements.

4. Account Registration and Security

To access certain features of the Service, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for an extended period.

5. Token System

GoGrowth uses a token-based system for accessing certain premium features:

  • Token Allocation: Tokens are allocated upon purchase and credited to your account
  • Token Usage: Tokens are consumed when accessing premium features or generating AI-powered content
  • Token Validity: Purchased tokens do not expire and remain in your account until used
  • Non-Transferable: Tokens cannot be transferred between accounts or exchanged for cash
  • Account Specific: Tokens are tied to your account and cannot be recovered if the account is deleted

6. Lifetime Access

"Lifetime Access" refers to access for the lifetime of the Service, not the lifetime of the user. Lifetime Access includes:

  • Access to all current features included in your purchase tier
  • Access to future updates and improvements to those features
  • No recurring subscription fees for included features

Lifetime Access does not guarantee:

  • Access to entirely new products or services launched separately
  • Indefinite operation of the Service (though we intend to operate it for the foreseeable future)
  • Compensation if the Service is discontinued (we will provide reasonable notice)

7. Acceptable Use Policy

When using the Service, you agree not to:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Share your account credentials with others or allow multiple users to use your account
  • Attempt to access the Service through unauthorized means
  • Use automated tools to scrape or extract content from the Service
  • Interfere with or disrupt the Service or servers
  • Redistribute, resell, or commercially exploit the content without permission
  • Use the Service for any unlawful or harmful purpose
  • Misrepresent your identity or affiliation

We reserve the right to terminate accounts that violate this policy without refund.

8. Intellectual Property

8.1 Our Content

The Service and its original content, features, and functionality are owned by Rosbech Media Consult ApS and are protected by international copyright, trademark, and other intellectual property laws. This includes:

  • The GoGrowth name, logo, and branding
  • Website design, layout, and user interface
  • Growth hack descriptions, categories, and organization
  • Educational content, guides, and documentation

8.2 Your Use Rights

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to:

  • Access and use the Service for your personal or internal business purposes
  • Implement growth strategies learned from the Service in your own business
  • Share insights from the Service with your team (within reasonable limits)

This license does not include the right to copy, reproduce, or redistribute our content for commercial purposes without explicit written permission.

9. Payment Terms

When making a purchase on GoGrowth:

  • Pricing: All prices are displayed in your local currency or USD and include applicable taxes where required
  • Payment Processing: Payments are processed securely through Stripe. We do not store your complete payment information
  • Billing: You will receive a receipt via email for all purchases
  • Currency: Prices may vary based on currency exchange rates
  • Promotional Offers: Discount codes and promotional offers may have additional terms and expiration dates

10. Refund Policy

10.1 Digital Content Acknowledgment

GoGrowth provides digital content and services. Under the EU Consumer Rights Directive, you have a 14-day withdrawal right for digital content. However, by making a purchase and gaining immediate access to the Service, you acknowledge and agree that:

  • You request immediate access to the digital content upon purchase
  • You understand that this means you waive your 14-day withdrawal right once content is accessed

10.2 Our Refund Commitment

Despite the above, we want you to be satisfied with your purchase. We offer refunds under the following circumstances:

  • Technical Issues: If you experience technical problems that prevent you from using the Service and we cannot resolve them within a reasonable time
  • Billing Errors: If you were charged incorrectly or multiple times
  • Service Not as Described: If the Service materially differs from what was described at the time of purchase

To request a refund, contact us at joceprod@gmail.com within 14 days of your purchase. Include your order details and reason for the refund request.

10.3 Non-Refundable Items

The following are generally non-refundable:

  • Tokens that have already been used
  • Purchases made more than 14 days ago
  • Accounts terminated for Terms violations

11. Service Availability

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we will provide advance notice when possible)
  • Unscheduled maintenance or emergency repairs
  • Technical difficulties or system failures
  • Factors outside our control (internet outages, third-party service disruptions)

We are not liable for any damages resulting from Service unavailability.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

  • No Warranty: The Service is provided "as is" without warranties of any kind, whether express or implied
  • No Guarantee of Results: We do not guarantee that implementing growth strategies from the Service will produce specific results for your business
  • Limitation of Damages: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
  • Maximum Liability: Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim

These limitations do not affect your statutory rights as a consumer under Danish or EU law.

13. Indemnification

You agree to indemnify and hold harmless Rosbech Media Consult ApS, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit or share through the Service

14. Termination

14.1 Termination by You

You may terminate your account at any time by contacting us at joceprod@gmail.com. Upon termination:

  • Your access to the Service will be revoked
  • Any unused tokens will be forfeited
  • We may retain certain data as required by law or for legitimate business purposes

14.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, if:

  • You breach these Terms
  • We are required to do so by law
  • Your conduct harms other users or our business
  • Your account has been inactive for an extended period

15. Dispute Resolution

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Denmark, without regard to its conflict of law provisions.

15.2 Informal Resolution

Before initiating formal proceedings, we encourage you to contact us to resolve any disputes informally. Many issues can be resolved quickly through direct communication.

15.3 Jurisdiction

Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Denmark.

15.4 Consumer Rights

If you are a consumer in the EU, you may also have access to the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make changes:

  • We will update the "Last updated" date at the top of this page
  • For material changes, we will provide notice via email or through the Service
  • Continued use of the Service after changes constitutes acceptance of the new Terms

If you do not agree to the modified Terms, you should discontinue use of the Service.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Rosbech Media Consult ApS regarding the Service and supersede all prior agreements and understandings.
